The trial started Monday in Benton County Circuit Court for a 23-year-old man accused of rape.
Wilson Scott Witzel, who currently lives in Lakeview, is charged with two counts of first-degree rape and one count of second-degree sexual abuse for an incident that took place in Benton County, according to an indictment filed March 18, 2016.
Witzel has pleaded not guilty to the charges.
The indictment alleges Witzel used forcible compulsion to engage in sexual intercourse with the victim on Sept. 27, 2015. The indictment also asserts the victim was incapable of consent by reason of mental incapacitation or physical helplessness and that she did not consent to the sexual intercourse.
The alleged victim underwent a sexual assault forensic examination on the same day as the incident, according to court documents. She reported the alleged rape to law enforcement two months later.
Witzel was living in Bend at the time of his March 7, 2016, arrest and was booked at the Deschutes County Jail, court documents show. Witzel was released from custody four days later on the condition that he have no contact with the alleged victim.
Witzel’s trial is set to last 12 days. The defendant is being represented by Portland attorney Lisa Maxfield. Deputy District Attorney Amie Matusko is prosecuting the case. Judge David Connell is presiding over the trial.
