On June 27, Eric Austin was killed in a vehicle collision while riding his bicycle across a crosswalk in Corvallis.
How do I request talking to the judge on Nov. 15 at the court hearing?
I am a 72-year-old bicycle rider recovering from hip surgery, three months ago, and hope to be back on the bicycle in December. I walk with a cane now, but would like to request the judge take the driver's right to drive away, forever. A speeding fine and driving classes are not enough.
If a person drives carelessly, meaning in a manner that endangers or would be likely to endanger any person or property then they can be charged with violation of Oregon Revised Statute 811.135 with the enhancement. The enhancement allows a court to sentence the driver to complete a traffic safety course and perform up to 200 hours of community service related to driver improvement.
If the driver fails to perform the sentence the court is allowed to levy a fine of up to $12,500 and suspend the driver’s license for one year.
