The flow of refugees that many in this country insist we just call “illegal immigrants” have every right to be here.

In July we heard from former Immigration and Customs Enforcement Director Tom Homan at a House oversight hearing stating that “when you enter the country illegally it’s a violation of 8 United States Code 1325." He went on to state that “if you want to seek asylum you go through the port of entry, do it the legal way.''

There are two problems with these comments. The first problem we encounter is that these comments presuppose that these refugees entered the country illegally; the second problem is that these comments presuppose that the only legal way for asylum seekers to enter the country is through a port of entry.

Of course, if we bothered reading the letter of the law, we’d immediately discover that the former ICE director was lying. If you take a look at 8 United States Code 1158, it specifically states: “Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien's status, may apply for asylum.” It’s imperative that we, as Americans, stay informed on this topic and are able to identify when powerful people lie to us.
